Terms of Use

In plain words. Roomier suggests photos and videos to clear out. You decide what happens, and iOS asks you to confirm before anything is deleted or changed. Cleared items go to Recently Deleted for up to 30 days. Roomier Pro is sold through Apple as an auto-renewing subscription or a one-time lifetime purchase, at the price shown in the App. Subscriptions renew until you cancel them in your Apple ID settings.

1. The agreement

These Terms of Use (the "Terms") are a legal agreement between you and the developer of Roomier, an independent developer based in Canada ("Roomier", "we", "us", "our"). They cover the Roomier app for iPhone (the "App") and the website at roomierapp.com (together, the "Service").

By downloading, installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. You must be old enough to enter into a binding agreement in your country, or have a parent or guardian agree on your behalf.

2. What Roomier does

The App scans the photo library on your iPhone, on the device, and groups items that appear to be exact duplicates, similar shots, blurry photos, screenshots, large videos and Live Photos. It then lets you review those groups, swipe through your library month by month, and clear out the items you choose. Pro features let you compress large videos and turn Live Photos into still photos.

The App requires an iPhone running a supported version of iOS and permission to access your photo library. Some features depend on capabilities of your specific device and iOS version.

Detection is automated and imperfect. Two photos may be grouped as similar when you consider them different, a sharp photo may be scored as blurry, and a group's "best" pick may not be the one you would choose. The App shows you every item before anything happens so you can correct it.

3. Your license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by the App Store's usage rules, for your own personal, non-commercial purposes. This license is for use only; we and our licensors keep all other rights.

4. Your photos and your decisions

Your photos and videos are yours. The App does not upload them and does not claim any rights in them.

You are responsible for what you clear out, compress or convert. Before making any change to your library, the App requires an action from you, and then iOS shows its own confirmation. When you confirm:

  • Items you clear out are moved by iOS to the Photos app's Recently Deleted album, where they can be recovered for up to 30 days before iOS removes them permanently.
  • Compressing a video creates a smaller copy and moves the original to Recently Deleted. The compressed copy has lower resolution or bitrate than the original.
  • Turning a Live Photo into a still saves a regular photo and moves the Live Photo to Recently Deleted.

Keep a backup of your library, for example with iCloud Photos, before using any cleaning tool. We are not responsible for photos or videos that you chose to clear out, compress or convert, for anything removed from Recently Deleted by iOS, or for changes made by other apps or by iCloud syncing.

5. Free use

You can use the App without paying. Free use includes scanning, reviewing every group, swiping, and clearing out a limited number of items per day. The App shows the daily limit and when it resets. We may change what is included free in future versions.

6. Roomier Pro

Roomier Pro removes the daily limit on clear-outs and unlocks video compression and Live Photo conversion. It is offered through Apple's in-app purchase system in these forms:

Prices, and any free trial, are shown in the App in your local currency before you buy. They vary by country and can change over time. The price in the App at the time of purchase is the one that applies. A change to an existing subscription's price is handled by Apple, which will notify you and, where required, ask for your consent before it takes effect.

7. Subscriptions and trials

  • Payment is charged to the Apple ID you use in the App Store when you confirm the purchase, or at the end of the free trial if you started one.
  • Automatic renewal. Subscriptions renew automatically for the same period at the price shown unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within 24 hours before the current period ends.
  • Free trial. When a plan offers a free trial, it is available to customers who have not used a Roomier trial before, as determined by Apple. The trial converts to a paid subscription when it ends unless you cancel at least 24 hours before that. Any unused part of a free trial is forfeited when you buy a different Roomier Pro plan.
  • Managing and cancelling. You can see, change and cancel subscriptions on your iPhone in Settings → your name → Subscriptions, or in the App Store app. Deleting the App does not cancel a subscription. Cancelling stops future renewals; you keep Pro until the end of the period you already paid for.
  • Switching plans. Moving between the weekly and yearly plans is handled by Apple according to its upgrade and downgrade rules.

8. Lifetime purchase

The lifetime purchase is a one-time, non-consumable in-app purchase. It unlocks Roomier Pro in the App for the Apple ID that bought it, for as long as the App is available on the App Store and supports the device you use, with no further payment. It is tied to your Apple ID, can be restored on your other devices using Restore purchases, and cannot be transferred or sold. "Lifetime" refers to the lifetime of the App, not of the purchaser. If we ever discontinue the App, the lifetime purchase will not be refunded by us beyond what Apple's policies provide.

9. Cancellation and refunds

Because every purchase is made through Apple, refunds are handled by Apple under its terms, not by us. You can request a refund at reportaproblem.apple.com. Cancelling a subscription does not refund the current period. Nothing in this section limits rights you have as a consumer under the law of your country that cannot be excluded by agreement.

10. Acceptable use

You agree not to:

  • copy, modify, distribute, sell, rent or sublicense the App or any part of it;
  • reverse engineer, decompile or otherwise try to obtain the App's source code, except where the law expressly allows it despite this term;
  • bypass, disable or interfere with purchase checks, the daily limit or any other feature of the App;
  • use the App to break any law, or in a way that harms us, Apple, or other people;
  • use automated means to interact with the App or this website beyond ordinary use.

11. Ownership

The App, this website, and everything in them except your photos (including the software, design, text, illustrations, the Roomier name and logo) belong to us or our licensors and are protected by copyright, trademark and other laws. These Terms do not give you any right to use our name or logo. If you send us feedback or suggestions, you agree we may use them without any obligation to you.

12. Apple and third parties

The App is distributed by Apple through the App Store, and purchases are processed by Apple. Your use of the App Store and of in-app purchases is also subject to Apple's terms, including the Apple Media Services Terms and Conditions. The App uses frameworks provided by iOS (such as the Photos framework, the Vision framework and StoreKit), which are governed by Apple's terms. The App does not include third-party advertising or analytics services.

13. No warranty

The App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the App will be error-free, uninterrupted, or will identify duplicates, similar or blurry items correctly. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, photos, videos, profits or goodwill, arising out of or relating to the App or these Terms, even if we have been told such damages are possible. Our total liability for all claims relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim and USD 50. These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

15. Indemnity

You agree to defend, indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App, to the extent permitted by the law that applies to you.

16. Termination

You can stop using the App at any time by deleting it; remember to cancel any subscription separately. We may suspend or end your license if you materially breach these Terms. Sections that by their nature should survive (including sections 4, 11, 13, 14, 15 and 18) survive termination.

17. Changes

We may update the App, add or remove features, and change these Terms. When we change the Terms we will post the new version here with a new effective date, and if the change is significant the App will point to it. If you keep using the App after a change takes effect, you accept the updated Terms. If you do not agree, stop using the App and cancel any subscription.

18. Governing law and disputes

These Terms are governed by the laws of Canada and of the Canadian province in which we are based, without regard to conflict-of-law rules, and disputes will be brought in the courts of that province. If you live in a country whose consumer protection law gives you the right to rely on your local law or courts, that right is not affected. Before starting any formal proceeding, please write to us; most problems can be sorted out by email within a few days.

19. Terms required by Apple

The following terms apply because the App is distributed through Apple's App Store:

  • Acknowledgement. These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
  • Scope of license. Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
  • Intellectual property claims. If a third party claims the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints and claims about the App can be sent to hello@roomierapp.com.
  • Third-party terms. You must comply with any applicable third-party terms when using the App.
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
